David J. McCabe is the senior partner and Chair of the Private Clients Group of Willkie Farr & Gallagher LLP in New York. Mr. McCabe specializes in all aspects of estate planning and administration, with emphasis on the development of sophisticated plans for high-net-worth individuals and their families.
Mr. McCabe’s practice includes the preparation of complex wills, trust agreements and related instruments, the representation of clients in estate tax and gift tax audits, and general counseling of clients in all phases of the administration of decedents’ estates. He represents non-resident aliens regarding U.S. tax aspects of their plans as well as U.S. persons establishing trusts off shore. He also represents banks and trust companies and has counseled bank trust departments on trusts and estates matters.
He advises fiduciaries and beneficiaries in estate and trust litigation matters in Surrogate’s Courts and the Supreme Court of the State of New York.
Finally, Mr. McCabe’s practice includes the representation of national public charities, private foundations and charitable trusts. He has advised directors and trustees of eleemosynary organizations on a variety of corporate and tax issues and has formed numerous private foundations and public charitable entities.
Mr. McCabe is recognized in Who’s Who in America (2006), (2007), (2008), (2009), (2010), Who’s Who in the World (2007), (2008), (2009), (2010), and is ranked among the nation’s leading individuals practicing in the area of Wealth Management: Eastern Region in Chambers USA (2006), (2010), (2011).

Mr. McCabe was formerly Chair of the Committee on Trusts, Estates and Surrogate’s Courts of the Association of the Bar of the City of New York and is a Fellow of the American College of Trusts and Estates Counsel. He was also elected to the Legal Board of Trustees of Iona College (2006), and is a member of
Trusts & Estates magazine’s Estate Planning and Taxation Committee and has authored articles for the magazine.
