Intellectual Property We represent foreign and domestic clients in litigation, transactions, counseling, prosecution, licensing and lobbying involving patents, trademarks, copyrights, domain names and trade secrets. Our expertise covers most industries and technologies, including computers, semiconductors, medical devices, pharmaceuticals, consumer products, financial trading systems, electronic devices, traditional and new media publishing, online and broadcast news, information and financial services, Internet commerce, renewable energy, sports, insurance and music rights. Our capacity to handle transnational matters is enhanced by our offices in the European business centers of Paris, London, Milan, Rome, Frankfurt and Brussels. Patent Litigation. Our patent trial lawyers have represented technology leaders in jury and non-jury cases in federal courts across the United States. We also regularly appear in other patent forums, including the U.S. International Trade Commission (ITC) and the U.S. Court of Appeals for the Federal Circuit. We have 35 attorneys working on active patent infringement cases. Our patent trial attorneys have technical expertise in computer science, electrical engineering, physics, mechanical engineering, biochemistry, industrial engineering, chemical engineering, biology and neuroscience. We are fortunate to count among our regular intellectual property clients three Fortune Global 250 companies, one of the nation’s largest privately held companies, and a collection of industry leading mid-size and start-up companies. We have prosecuted and defended patent infringement cases involving technologies such as financial trading systems, medical defibrillators, semiconductors, pharmaceuticals, electronic toothbrushes, medical devices, high-pressure mercury vapor lamps, high-speed sorting equipment, mechanically locking floor panels, integrated circuit communication protocols and mailing systems. Technology Transfer and Transactions. Our technology transfer work includes developing and implementing licensing strategies for patents, trademarks, copyrights and other technology. After a strategy is in place, we identify key intellectual property, analyze infringement, negotiate the license agreements, and litigate any resulting disputes. Our licensing and transactional IP attorneys counsel clients on joint development, software development and Internet agreements. Our transactional expertise includes the intellectual property aspects of mergers, acquisitions, initial public offerings, financings, securitizations and joint ventures. Copyrights and Trademarks. We are routinely retained to handle complex trademark issues of all types. We have prosecuted and maintain over 9,000 trademark files in over 95 countries. We represent clients in cases involving trademark infringement and dilution, counterfeiting, cyber-squatting and false advertising. We handle oppositions and cancellations before the Trademark Trial and Appeal Board. We counsel clients on the strategic management and enforcement of their trademark portfolios in the United States and abroad. We negotiate and draft trademark licenses and naming rights agreements. Our copyright and trademark attorneys draw upon years of experience to achieve results for our clients. Our copyright practice focuses on traditional and new media publishing and broadcasting, drafting and negotiating publishing agreements, and counseling clients concerning data use. We represent clients in copyright infringement cases in federal courts. We have expertise in copyright registration, licensing, fair use and rights clearances. Domain Names. We have assisted clients in registering top-level and country top-level domain names in over 115 countries. Additionally, we have successfully prosecuted numerous ICANN (Internet Corporation for Assigned Names and Numbers) proceedings and civil actions to recover domain names in more than a dozen countries. What Sets Us Apart. Unlike the "boutique" intellectual property firms, we bring to bear the full resources and expertise of a general practice firm on our clients' intellectual property issues. For example, our antitrust attorneys regularly assist us when allegations of anticompetitive behavior are involved in patent litigation or standards-setting counseling; the deep bench provided by our general litigation attorneys enables us efficiently to staff patent cases of any complexity; our tax attorneys advise us concerning the domestic and foreign tax implications in structuring settlement agreements; our corporate attorneys provide unequalled expertise in handling the non-IP aspects of corporate transactions; and our telecommunications attorneys in our Washington, Paris and Frankfurt offices provide expertise on transactions, licensing and patent litigation involving issues that are unique to the communications industry. And while there are other general-practice firms that offer intellectual property services, few of them boast the technical depth and experience trying patent cases of our patent trial lawyers. |
